Criminal Original Petition filed under Section 482 Cr.P.C., praying to direct the respondents to take appropriate action to register the FIR on the complaint dated 19.12.2014 and investigate the same and pass final report in the above complaint and pass suitable orders.

O R D E R

This Criminal Original Petition has been filed to direct the respondents to take appropriate action to register the FIR on the complaint dated 19.12.2014, investigate and pass final orders.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents.

3. It is seen that, earlier the petitioner had given a complaint and the matter was amicably resolved between the petitioner and the opposite party, which has been recorded by this Court vide order dated 04.09.2014 in Crl.OP.No.28532 of 2013. The petitioner is https://hcservices.ecourts.gov.in/hcservices/

alleging that the opposite party is preventing the petitioner from approaching the Civil Court.

4. It is always open to the petitioner to approach an advocate and file a civil suit and that cannot be prevented by anyone. Since, the complaint does not disclose commission of cognizable offence, no positive direction can be issued to register an F.I.R.

5. With the above observation, this Criminal Original Petition is closed with liberty to the petitioner to work out his remedy in the manner known to law.
