Respondent Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus to direct the respondent herein to pay subsistence allowance to the petitioner during the period of his suspension at the rate provided under the Model Standing Order of Minimum wage, whichever is higher from the date of petitioner's suspension till completion of enquiry, and direct the respondent to complete the enquiry, against the petition within stipulated time.

ORDER

The petitioner was appointed as a Salesman in Tamil Nadu State Marketing Corporation Limited (TASMAC). He was placed under suspension. The suspension order was issued on 24.07.2014. It is the grievance of the petitioner that further action was not taken pursuant to the suspension order and he is made to suffer.

2. The learned Standing counsel for TASMAC, on instructions, submitted that disciplinary proceedings would be completed within a period of three months. The Standing counsel further submitted that subsistence allowance would be paid to the petitioner in accordance with the regulations. https://hcservices.ecourts.gov.in/hcservices/

3. The respondent is directed to dispose of the disciplinary proceedings initiated against the petitioner as expeditiously as possible and in any case, within a period of three months from the date of receipt of a copy of this order. The petitioner should be paid subsistence allowance in accordance with the regulations till the disposal of disciplinary proceedings. The entire arrears should be paid as expeditiously as possible and in any case, within a period of one month from the date of receipt of a copy of this order.

4. The writ petition is disposed of with the above direction. No costs. Connected miscellaneous petition is closed.
