(Crime No.62/2021) Prayer:- Criminal Original Petition filed under Section 439 of the Code of Criminal Procedure seeking to enlarge the petitioner on bail in Crime No.62/2021 pending investigation on the file of the respondent police for the alleged offence under Sections 341, 307, 302 of IPC thereafter the respondent police altered the ofference under Sections 376(A), 302 of IPC.

ORDER

The petitioner, who was arrested on 19.02.2021 for the offences punishable under Section 341, 307, 302 IPC altered the offence under Section 376(A), 302 IPC in Crime No.62/2021, on the file of the respondent police, seeks bail.

2. It is seen from the submissions that the petitioner said to have inserted stick into the vagina of the deceased and killed her by dropping stone on her head.

3. The learned counsel appearing for the petitioner is in judicial custody from 19.02.2021. He is an innocent person and therefore, he seeks bail.

4. However, the learned Additional Public Prosecutor strongly opposes this petition on the ground that the deceased was cruelly killed by the petitioner and that the police authorities are taking steps to complete the investigation and to file a Final Report. https://hcservices.ecourts.gov.in/hcservices/

5. Taking note of the submissions and also the manner in which the deceased said to have been murdered, this Court is not inclined to grant bail to the petitioner.
