O R D E R

(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 09.07.2020 for the offences punishable under Section 174 (iii) of Cr.P.C. subsequently altered into for an offence under sections 294(b), 498(A), 306 of I.P.C., in Crime No.773 of 2020, seeks bail.

2.The case of the prosecution as per the defacto complainant Murugesh is that her daughter Kavitha married the petitioner 6 years back and she got one male child. On 08.07.2020, the defacto complainant received an information that, his daughter had committed suicide by hanging at the matrimonial home. On enquiry it was found out that the petitioner along with his family members harassed the deceased by demanding dowry, due to which the daughter of the defacto complainant committed suicide. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the marriage between the petitioner and the deceased took place in the year 2014. He would also submit that the victim committed suicide, since she suspected that the petitioner is having illegal relationship with some other woman and there is no abetment or demand of dowry. The petitioner was arrested on 09.07.2020 and he is in https://hcservices.ecourts.gov.in/hcservices/

judicial custody for more than 23 days.

4.The learned Government Advocate (Criminal Side) would submit that the case has been registered very recently on 09.07.2020. He would further submit that the respondent had referred the matter for RDO Enquiry and it is pending. He would further submit that the investigation is at initial stage.

5.Consideration the facts and circumstances, and also the fact that the investigation is at initial stage and RDO investigation is also pending, this Court is not inclined to grant bail to the petitioner.
