Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to declare the first petitioner as major and discharge her mother namely the second petitioner herein as her guardian and permit the first petitioner to proceed with the CMA in her individual capacity as major along with Second petitioner IN (CMP No.15400 of 2017 IN CMA.1961/2009).

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S V.S KESAVAN, Advocate for the petitioner and of M/S.R.NEETHI PERUMAL, Advocate for 3rd Respondent the court made the following order:- This petition has been filed by the Petitioners seeking to declare the first petitioner, Saranya, as major and discharge her mother, namely, the second petitioner, as her guardian and to permit the first petitioner to proceed with the above Appeal, in her individual capacity, as major, along with the second petitioner.

2. Heard the learned counsel for the petitioners.

3. It is claimed that the date of birth of the first petitioner is 03.06.1997, which is supported by the Birth Certificate, issued by the Government of Tamil Nadu, under Sections 12/17 of the Registration of Births and Death Act, 1969 and Rule 8 of the Tamil Nadu Registration of Births and Death Rules, 2000.

4. Hence, the first petitioner, Saranya, is declared as major and consequently, her mother, namely, Lakshmi (the second petitioner), is discharged from the guardianship of the first petitioner and permission is hereby given to the first petitioner to proceed with the above Appeal, in her individual capacity, as major, along with the second petitioner.

5. This CMP is ordered accordingly.
