The writ on hand has been instituted questioning the validity of the refusal check slip issued by the Sub Registrar / 4th respondent.
2. The learned counsel for the petitioner states that a Settlement Deed was presented before the Sub Registrar for registration along with the particulars and the Sub Registrar returned the document along with the impugned refusal check slip stating that the petitioner has not enclosed the relevant documents.
3. The learned Special Government Pleader appearing on behalf of the respondents raised an objection by stating that the petitioner ought to have submitted the original documents for registering a Settlement Deed which 2/5
was presented before the Sub Registrar. If the original documents are not available, atleast the certified copy of the documents are to be produced for verification in order to ascertain the correctness of the documents presented before the Sub Registrar by the petitioner. The reasons stated in the refusal check slip is inconsonance with the provisions of the Registration Act. The petitioner is at liberty to submit all the relevant documents as sought for by the Sub Registrar for registering the Settlement Deed presented by him for registration. In the event of producing all such relevant documents, the respondents shall initiate appropriate action for registration of document by following the provisions as contemplated under law.
4. With the above observations, the Writ Petition stands disposed of. There shall be no order as to costs.
