Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to consider the petitioner's three online applications dated 29.01.2024 and representation dated 30.01.2024 consequently direct the respondent to survey my properties bearing S.Nos.41, 42/2, 42/4 in Tambaram Village, Chengalpattu District, issue patta to us.

ORDER

This writ petition is filed to direct the respondent to consider the petitioner's three online applications dated 29.01.2024 and representation dated 30.01.2024, consequently direct the respondent to survey the properties 1/4

bearing S.Nos.41, 42/2, 42/4 in Tambaram Village, Chengalpattu District and to issue patta.

2. By consent of both parties, the Writ Petition is disposed of at the admission stage itself.

3. The case of the petitioner is that the petitioner was in possession and enjoyment of a land in Ward No.D, Block No.28, bearing S.Nos.230/3A1, 3A2A, 3A2B, 3A2C, 3A2D, 3B about 9 cents, now changed as T.S.Nos.41, 42/2 and 42/4, where house and shops are available. Vide Doc.No.3112/2016 dated 09.06.2016 on the file of the Sub Registrar, Tambaram, the petitioner settled his property in his wife Valarmathi's name. Thereafter, the petitioner's wife settled part of the above property in T.S.Nos.42/2 and 42/4 about 904 sq.ft. vide Doc.No.5705/2023 dated 13.07.2023 in favour of the petitioner's daughter Devatharshini. It is the grievance of the petitioner that the petitioner has made three online applications on 29.01.2024 to survey the said property in S.Nos.41, 42/2 and 42/4 in Tambaram village and give subdivision patta to the individual land owners and has also given a representation dated 30.01.2024 to the respondent seeking to measure the petitioner's properties and to give separate patta. However, the same has not been considered by the 2/4

respondent. Hence, the present Writ Petition.

4. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondent and perused the materials available on record.

Considering the limited relief sought for in this writ petition, the respondent is directed to consider the representation of the petitioner dated 30.01.2024 and pass appropriate orders on the petitioner's representation for survey of the property and to issue separate patta, after giving notice to the neighbouring land owners and any other interested persons, within a period of two months from the date of receipt of a copy of this order.
