Respondent Writ petition filed under Article 226 of the Constitution of India, praying for a writ of mandamus directing the respondent to give permission to conduct the cinema drama programme at Rajarajasolan Peruudaiyar auditorium, Pottanam Village, Senthamangalam Taluk, Namakkal District in connection with the festival of Sri Mariamman Thiruvila on 18.05.2018 [8 pm to 1 am] representation dated 18.04.2018.

ORDER
The petitioner seeks a mandamus to direct the respondent to grant permission to conduct cinema/dance/cultural program during Sri Mariyamman Temple Festival to be conducted on 18.05.2018 at Rajarajasolan Peruudaiyar auditorium, Pottanam Village, Senthamangalam Taluk, Namakkal District by considering his representation dated 18.04.2018. Heard the submissions of the learned counsel for the petitioner as well as Mr.V.Kathirvel, learned Special Government Pleader who accepts notice on behalf of the respondent.

DR.G. JAYACHANDRAN, J., AP This Court, on perusal of the affidavit and the typed set of documents, is of the view that granting permission to conduct cultural programmes is always subject to the peace and tranquility in the locality / village where such program is supposed to be conducted and also, the antecedents and locus of the person who seeks permission matters. Further, the representation of the petitioner to conduct Cinema/Dance programme, in the public, during night hours from 8.00 p.m. to 1.00 a.m. on 18.05.2018, on the face of it, does not appear to be proper and conducive for the peace and tranquility of the public. This can be gone into only by the local/jurisdictional police. Hence, this Court is not inclined to entertain this writ petition. It is always open to the petitioner to approach the jurisdictional police and if it is conducive, the authority concerned / jurisdictional police shall grant permission to conduct such cultural program.
The writ petition stands disposed of with the above observation. No costs.
