ORDER
The petitioners, who were arrested on 29.03.2021 for the offences punishable under Sections 147, 148, 294(b), 324, 506(ii) 307 I.P.C @ Section 302 of IPC in Crime No.253 of 2021 on the file of the respondent police, seek bail.
2.The case of the prosecution is that due to previous enemity, on the date of occurrence, the accused attacked the defacto complainant and his friend one Sathish with a knife. As a result of which, Sathish died instantaneously. Hence, the complaint.
3.The learned counsel for the petitioners submitted that the petitioners are innocent and that the defacto complainant also attacked the petitioners with wooden log and that they are in judicial custody from 20.03.2021 and seeks bail for the petitioners. 4.The learned Government Advocate(Crl. Side) submits that that the co-accused/A6 has already been released on bail by this Court in Crl.O.P.No.8841 of 2021 and that investigation is still pending and prays for dismissal of this petition.
5.Considering the period of incarceration of the petitioners and also the present COVID - 19 pandemic situation, this Court is inclined to grant bail to the petitioners subject to the following conditions:
(a)The petitioners are ordered to be released on bail on executing their own bond for a sum of Rs.10,000/- ( Rupees ten thousand only) each, before the Superintendent, Central Prison, Puzhal, and thereafter on their release; (b)the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the Judicial Magistrate No.II, Ponneri, within 15 days from the commencement of the Court's normal functioning, failing which, the bail granted by this Court shall stand cancelled automatically;
(c)the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.
(d)the petitioners shall report before the respondent police daily at 10.30 am., until further orders.
(e)the petitioners shall not abscond either during investigation or trial.
(f)the petitioners shall not tamper with evidence or witness either during investigation or trial.
(g)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
(i)If the accused thereafter absconds, a fresh FIR can be registered under Section 229A IPC.
