Petitioner has come up with the present petition seeking to transfer the investigation to some other investigating agency which was registered in Crime No.882 of 2015 pending on the file of the respondent herein.
2. The case of the petitioner is that his father, Durai Pandian and his sister Shanthi went to take delivery of the New Honda Activa from Palladam Honda Activa Showroom, Tiruppur District on 14.07.2015 which was booked for his sister. After taking delivery of the same, the sister of the petitioner drove the new Honda Activa and his father was driving the Splendour motor bike and returning to house. On the way, a lorry came in a rash and negligent manner and hit against the New Honda Activa and speed away. On account of the said accident, the petitioner's sister sustained grievous injuries and her right leg was amputated. It is the specific case of the petitioner that though a case has been registered under Sections 279 and 337 of IPC, till date no action had been taken.
3. Learned Additional Public Prosecutor submits that on completion of investigation one Mahendran, driver of the lorry was arrested and the respondent will file the final report in a short span of time.

4. Learned counsel for the petitioner would submit that though the accused was arrested, the vehicle which had caused the accident was not seized.
5. But the learned Additional Public Prosecutor submitted that the vehicle will be seized during the course of investigation.
6. In view of the submissions made by the learned Additional Public Prosecutor, there is no need to give any further direction to the respondent. However, the respondent is directed to expedite the investigation and file a final report as early as possible. This criminal original petition is disposed of.
