O R D E R

This petition has been filed seeking a direction to the 2nd respondent to register the petitioner's complaint dated 07.07.2015.

2. It is seen that one Gandhi is a tenant of the house belonging to the petitioner/de facto complainant. The monthly rent is fixed at Rs.3,800/-. The said Gandhi is irregular in the payment of monthly rent for the period commencing from October 2014 to till date. When the petitioner questioned Gandhi for the outstanding rent amount, the petitioner https://hcservices.ecourts.gov.in/hcservices/

was threatened with dire consequences. Hence, the petitioner lodged a complaint to the 2nd respondent. But, till date, the respondent police has not registered any case on his complaint. Hence, the present petition has been filed.

3. Learned Additional Public Prosecutor submits that, the dispute between the parties only with regard to rent amount and therefore, the issue cannot be dealt by the police.

4. As contended by the learned counsel for the petitioner, allegation with regard to the recovery of outstanding rent amount, cannot be dealt by the respondent. The petitioner has to seek his remedy only before the Rent Control Tribunal.

5. Hence, this Court is not inclined to grant any direction to the respondent on the complaint lodged by the petitioner dated 07.07.2015 and hence the petition stands dismissed.
