Respondent Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, to call for the records connected with the E-Auction Notice dated 03.04.2023 (served to the petitioners on 10.04.2023) the auction to be held on 26.04.2023 issued by the Respondent and quash the same and consequently direct the Respondent to grant time to settle the loan as one time settlement to the petitioners.

ORDER
(Order of the Court was made by The Hon'ble Chief Justice) We have heard Mr.S.Ilamvaludhi, learned counsel for the petitioners and Mr.W.M.Abdul Azeez, learned counsel for the bank.
2. The petitioners are challenging the e-auction notice dated 03.04.2023 and also seeking directions against the respondent to grant time to the petitioners to settle the loan as one time settlement.
3. The learned counsel for the petitioners submits that the bank has called the petitioners tomorrow for discussion.
4. The learned advocate for the petitioners, on instructions, makes a statement that the auction that was scheduled pursuant to eauction notice dated 03.04.2023 could not materialize and the auction has not taken place.
5. In view of that, the purpose of the writ petition now challenging e-auction notice does not survive. With regard to the settlement, it is already submitted that the petitioners have been called by the bank tomorrow. It is for the petitioners to approach the bank and for the bank to consider the request of the petitioners, as may be permissible.
