PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, directing the respondent 1 to 2 to give suitable police protection to petitioner's life from the hands of the 3rd respondents in pursuant to petitioner's representation dated 14.02.2023. The Writ Petition has been filed to direct the the respondent 1 to 2 to give suitable police protection to petitioner pursuant to petitioner's representation dated 14.02.2023.
2. The learned counsel for the petitioner submitted that, petitioner is residing in his farm house at Iyyansuthamalli with his family members. He used to visit his farm house twice in a month. Petitioner appointed watchman to his farm house. One senthil with a view to grab petitioner's property, trespassed into the petitioner's property and damaged the articles inside the house and removed the CCTV Camera. On the basis of the complaint given by the petitioner, FIR in Crime No.280 of 2022 was registered for the offence under Sections 341, 379 & 448 of IPC and Section 3 of TN Public Property ( Prevention of Damage and Loss) Act, 1992 and it is pending. The said Senthil belongs to Upper Caste and petitioner belongs to lower caste. Therefore, Senthil threatened the petitioner not to enter into the village and also made criminal intimidation. Therefore, petitioner gave a representation dated 14.02.2023 to the 1st respondent seeking police protection. However, till now, it is not considered, necessitating the filing of this petition.
3. The learned Government Advocae (Crl. Side) submitted that, petitioner's representation dated 14.02.2023 is available with the 1st respondent and appropriate orders will be passed after conducting enqruiy.
4. In the light of the submission made by the learned Government Avocate (Crl. Side), this Court directs the 1st & 2nd respondent to consider the petitioner's representation dated 14.02.2023 and pass appropriate orders in the manner known to law, within a period of two weeks from the date of receipt of copy of the order.
4. With the above observations and directions, this Writ Petition is disposed of.
