O R D E R
(The case has been heard through video conference) The petitioners, who were arrested and remanded to judicial custody on 04.02.2020 for the offences punishable under Section 395 r/w 397 @ 457. 457 r/w 114, 395 r/w 397 IPC, Crime No.458 of 2017, seek bail.
2. The case of the prosecution is that when the defacto complainant and his wife were in their house on 11.10.2017, at about 1.30 p.m. five unknown persons broke open the lock of grill gate and entered into the house and threatening the inmates with knife point have snatched 21 1⁄2 sovereigns of gold jewels and a sum of Rs.20,000/- .
3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they have been falsely implicated in this case. He would further submit that the petitioners were arrested and remanded to judicial custody from 14.10.2017.He would further submit that the investigation is over and the case has also taken up for trial in S.C.No.27 of 2020.
4. The learned Government Advocate (Crl. Side) would submit that the petitioners are notorious elements and there https://hcservices.ecourts.gov.in/hcservices/
are 44 previous cases of similar nature pending against them in various districts.
5.Taking into consideration of the fact that the petitioners have involved in 44 previous cases of similar nature, this Court is not inclined to grant bail to the petitioners. However, a direction is issued to the learned Principal Sessions Judge, Namakkal to complete the trial in S.C.No.27 of 2020 preferably within a period of six months from the date of lifting of lockdown and resumption of normal functioning of the Courts.
6.With the above observation, this petition stands dismissed.
