Today, when the matter was taken up, the learned counsel appearing for the appellant produced a memo dated 23.10.2017, before this Court stating that the respondent has submitted his letter of resignation dated 23.08.2017 and the same has also been accepted by the petitioners' society and hence sought this Court to dismiss the appeal, as not pressed.

2. In view of the Memo dated 23.10.2017 of the appellant, the Second Appeal is dismissed as not pressed. Consequently, the connected Miscellaneous Petition is closed. No costs.
