Order This Criminal Original Petition is filed under Section 528 of BNSS (Sectio 482 of Cr.P.C.), praying to transfer the investigation, pending in Crime No. 2 of 2026 dated 30-1-2026, on the file of W26 Ashok Nagar All Women Police Station, Chennai to some other investigating agency to be investigated under the supervision of higher authorities with immediate effect to secure the ends of justice.
2.The petitioner sought transfer of investigation on the sole ground that the FIR was registered only under Section 4 of Tamil Nadu Women Harassment Act, 1988 and that no provisions of the BNS, 2023, namely Sections 74, 75, 77, 78, 79, 108, 115, 118, 294, 308, 351, 351(2), 356, (b) Sec.35(l) BNSS and (c) Sections 66E, 67/67-A of IT Act 2000, were registered against the accused, as they were deliberately, wilfully and wantonly omitted for the reasons best known to the 2nd Respondent Police. Hence, the petitioner filed this petition seeking transfer of the investigation in Crime No.2 of 2026 to some other Police station.
3.On instructions, the learned counsel for Government Advocate submitted that the second respondent had completed the investigation in Crime No.2 of 2026 and filed the final report on 31.05.2026, before the XXIII
Metropolitan Magistrate Court, Saidapet, Chennai and that the said XXIII Metropolitan Magistrate Court, Saidapet, Chennai, had taken it on file. 4.In view of the submission made by the learned counsel for Government Advocate, there is no question of transferring the investigation from the file of the second respondent to any other Police station, as the investigation in this case has already been completed and the final report has been filed before the XXIII Metropolitan Magistrate Court, Saidapet, Chennai. 5.Accordingly, this Criminal Original Petition stands dismissed.
