[Order of the Court was made by R.SURESH KUMAR, J.] This civil miscellaneous petition has been filed to condone the delay of 23 days in filing of the above tax case appeal.

2. Heard the learned counsel appearing for the petitioner.

3. Though notice had been directed to be served which was returned as unclaimed, when that being so, it can be construed as a service and the delay is also 23 days.

3. Having satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is ordered and the delay is condoned.
