Against the judgment of conviction, he has preferred appeal before the Principal Sessions Judge, Tiruppur along with appeal he also moved an application for suspension of sentence without surrenderring himself before the Court. The lower appellate Court dismissed the application for suspension of sentence recording the reason that absconding convict cannot as a matter of right seeking suspension of sentence without submitting himself to the law. Hence this Court finds no error in the judgment of the Court below. This Criminal Original Petition is dismissed accordingly.
