O R D E R
(The case has been heard through video conference) The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294(b), 323, 324, 307, 506(2) of IPC in Crime. No.760 of 2020 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution as per the defacto complainant is that on 08.05.2020 due to money dispute, the petitioner along with other accused attacked the defacto complainant and caused injuries on his head and shoulder. Hence, the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case since, he happens to be known to the other accused. He further submitted that co-accused has been granted bail. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor submitted that the petitioner is arrayed as A3 in this case and he has got one previous case of Section 302 IPC to his credit. Hence, he vehemently opposed to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
5. Taking into account of the facts and circumstances and the antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
