In Paragraph-3 of the affidavit, filed in support of the petition, the petitioner has stated that he was taking treatment for his ailment and therefore, the papers could not be represented in time.
Since the delay is on a higher side, I am of the view that the delay can be condoned on payment of cost. Accordingly, the delay of 348 days in representing the papers is condoned on condition that the petitioner paying a sum of Rs.750/- (Rupees seven hundred fifty only) to the Hon'ble The Chief Justice Relief Fund within two weeks from the date of receipt of a copy of this order, failing which, the order shall stand automatically vacated without any further reference to this Court.
