Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 1st and 2nd respondents to consider the representation of the petitioner dated 13.02.2024 to nullify the 3rd respondent's order dated 07.07.2022 passed in Se. Mu. Order No. A4/3267/2022 concerning on a portion of order thereby classifying the agricultural lands pertaining to Survey No. 164/1 and Survey No. 164/2 as Tharisu land instead of being in the nature of Punja land as invalid and perverse for not being in accordance with law and consequently direct the 3rd and 4th respondents to consider for issuance of patta in favour of the petitioner in respect of the lands 1/5

situated at Thiruvannamalai Registration District, Chengam Sub-Registration District, Porasapattu Village comprised in Survey No.164, taking into account the Assignment Patta, bearing No.DK.86/F/1415 issued to the petitioner on 13.07.2005.

This Writ Petition is filed seeking for issuance of a mandamus to 1st and 2nd respondents to classify the petitioner's land (morefully described in the prayer to this Writ Petition) as Punja Land, instead of present classification as 'Tharisu Land', based on the representation of the petitioner dated 13.02.2024 and to issue patta in favour of the petitioner by taking into account the Assignment Patta issued to the petitioner on 13.07.2005 within a time frame to be fixed by this Court. 2/5

3. Till date, counter affidavit has not been filed by the respondents in this Writ Petition.

4. No prejudice would be caused to the respondents if the petitioner's representation (as stated supra) is considered by them on merits and in accordance with law, after hearing objections, if any, from any other third party, as the respondents deem fit to enquire within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the representation made by the petitioner.

For the forgoing reasons, this Court directs the second respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 13.02.2024 seeking reclassification of the land as punja land instead of Tharisu Land pertaining to the property, morefully described in the prayer to this Writ Petition and consequently, to issue patta in favour of the petitioner after hearing objections, if any, from any other third party, as the second respondent deems fit to enquire within a period of four months from the date of receipt of a copy of this order. 3/5

6. With the aforesaid direction, this Writ Petition is disposed of. No costs.
