Respondents Prayer: Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, pleased to direct the 1st respondent, the Superintendent of Police, Chengalpattu District and his subordinate the 2nd respondent the Inspector of Police (Crime), Kilambakkam Police Station, Chennai not to harass the petitioner.

The petitioner who under the guise of purchase of the second hand car from the defacto complainant had not paid the value of the car nor return the car. Hence the complaint been given and it is under investigation.

The learned Government Advocate (Crl.Side) appearing for the State submits that on 04.03.2024, the petitioner appeared and agreed to pay the balance sale consideration of the car on or before 04.04.2024. Therefore, the police has not proceeded against him for the offence of cheating. However, without complying the undertaking, he has approached this Court making false allegations that he has been harassed by the police.

In view of the above fact, if the petitioner herein failed to comply his undertaking, the respondent police is at liberty to proceed against the complaint given by the defacto complainant/Mohan and act in accordance with law.
