A.No.1979 of 2021:- Application praying that this Hon'ble Court be pleased to issue a summary judgment, granting a decree in favour of Applicant to the tune of Rs.11,00,00,000/- together with interest thereon @ 18 % p.a. from 06.01.2020 until date of payment in full, on the basis of the written admission by the 1st Respondent herein.
A. No.1981 of 2021:- Application praying that this Hon'ble Court be pleased to grant an order of interim injunction restraining the respondents/defendants herein from alienating, encumbering or creating any manner of third party interest in or over the properties described in schedule hereto, pending the above suit.
These applications coming on this day before this court for hearing in the presence of Mr.Srinath Sridevan, Advocate for the applicant in both applications and Mr.K.Muthu Ramalingam, Advocate for the 1st respondent herein, and Mr.R.Murali, Advocate for the respondents 2 to 8, and
Mr.K.Ramu, Advocate for the 9th respondent in both applications, and upon reading the order dated 15/02/2022 made in A.No. 1979 of 2021 in C.S.(Comm.Div.)No. 193 of 2021 and order dated 21.12.2021 made in A.No.1981 of 2021 in C.S.(Comm.Div.)No. 193 of 2021, and the first defendant has not complied with the order dated 15.02.2022 by which costs of Rs.15,000/- were imposed and the learned counsel submitted that the web-copy was made available today and that he requires extension of time to comply with the order, it is ordered as follows:
That the time for compliance with the order dated 15.02.2022 made in A.No.1979 of 2021 directing the 1st respondent/1st defendant to pay a sum of Rs.15,000/- (Rupees Fifteen Thousand only) as costs to the applicant/plaintiff be and are hereby extended till 15.03.2022.
2. That the order of interim injunction granted in pursuance of the order dated 21.12.2021 made in A.No.1981 of 2021 restraining the 1st respondent therein, from alienating and/or encumbrancing the plaint property more fully setout in the Schedule H thereunder be and are hereby extended until the next date of hearing i.e. 15.03.2022.
3. That the A.Nos. 1979 & 1981 of 2021 in C.S.(Comm.Div.)No. 193 of 2021 be posted on 15.03.2022.
