2.The learned counsel appearing on behalf of the respondents 2 to 8 submitted that these respondents will not alienate and/or encumber the properties pending disposal of the suit. The said undertaking is recorded. Insofar as the 9th respondent is concerned, the learned counsel for the 9th respondent submitted that the property described in Schedule H of the plaint, was sold absolutely in favour of the 1st respondent by sale deed dated 18.03.2009 through document No.861 of 2009 and that the 9th respondent is no more the owner of the property. By virtue of the stand taken by the 9th respondent, there shall be an order of interim injunction restraining the 1st respondent from alienating and/or encumbrancing the property more fully Page No.1/3
