O R D E R
This Writ Petition has been filed seeking a direction to permit the petitioner to travel to Dubai for a period of one month from the date of the order, for the purpose of renewing his work permit-cum-visa issued by his employer, namely, M/S First Events LLC.
2. The learned counsel for the petitioner submitted that the petitioner is required to travel abroad to apply for renewal of the abovementioned visa and work permit, failing which his employment would be
affected.
3. The learned Government Advocate (Criminal Side), however, submitted that the investigation in Crime No. 222 of 2023, registered for the offences punishable under Sections 376 and 506(i) of IPC, is still pending. Further, this Court, by order dated 13.02.2025 in W.P. No.40005 of 2024, had already directed the third respondent herein to complete the investigation and file the final report within a period of eight weeks from the date of receipt of the said order. Therefore, the investigation is nearing completion, and at this stage, permitting the petitioner to travel abroad may hamper the progress of the case.
4. Heard both sides and perused the materials placed before this Court.
5. Upon consideration of the submissions made by both sides, this Court is of the view that, since the investigation is still pending and nearing completion, and taking into account the nature of the allegations involved, it would not be appropriate to grant permission to the petitioner
to travel abroad at this stage. Any such permission, before completion of the investigation, may prejudice the course of justice.
