Prayer: Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to transfer the investigation in Cr.No.338/2023 pending on the file of the 1st respondent police to the 3rd respondent or any other 1/5
agency for fair and thorough investigation.

O R D E R
Dispute between father and son has culminated into criminal complaint which has been registered in Cr.No.338 of 2023 dated 09.09.2023 by the Neelankarai Police Station who is the first respondent herein.
2. The present petition is filed to transfer the investigation from the local police station to Central Bureau of Investigation alleging that there is no progress in the investigation, the information gathered by the petitioner herein. The money and other properties has been forcibly taken away from his flat. Now been transferred to other places beyond the jurisdiction of the first respondent.
3. The learned Government Advocate (Crl.Side) appearing for the respondent police states that based on the complaint the disputed 2/5
property was listed by the police and at that time the father of the petitioner was there, some of the properties were recovered and handed over to the petitioner. In the meanwhile, the father of the petitioner died on 27.12.2023. Regarding the other accused,investigation is going on.
4. A5 claims that he has paid advance for a sum of Rs.5,00,000/- for purchasing the property and holding the original title deed with him.
5. The learned Government Advocate (Crl.Side) states that these are matter for investigation and within three months, they will complete the investigation and file final report.
6. The learned Special Public Prosecutor (for CBI Cases) for the third respondent submits that the content of the complaint as such does not warrant investigation by CBI.
7. In view of the above facts, this Court dispose of the Criminal Original Petition directing the first respondent to complete the investigation within a period of three months and file final report. 3/5
