ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Section 135 of Customs Act in F.No.S.Misc.91 of 2021 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the vehicle bearing Registration No.TN 04 AC 5025 was found to be parked near Cargo CFS carrying goods with forged check-list for exporting the same. When the officials examining the petitioner, it came to know that he was found in illegal possession of 1176 Kgs. of wooden logs which appeared to be red sanders. Hence, the complaint. 3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant of anticipatory bail to the petitioner. 4.The learned Special Public Prosecutor submitted that the petitioner is a habitual offender and further submitted that there are four previous cases pending against the petitioner. https://hcservices.ecourts.gov.in/hcservices/
5.Considering the fact that the petitioner is a habitual offender and there are four previous cases pending against him similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner.
