[JUDGMENT OF THE COURT WAS DELIVERED BY C.T.SELVAM,J] The Civil Miscellaneous Appeal has been preferred against the order and decreetal order dated 31.03.2012 made in I.A.No.919 of 2012 in O.S.No.250 of 2011 on the file of learned 1st Additional Principal Judge, Family Court at Chennai. Suit in O.S.No.250 of 2011 has been filed by respondents 1 to 4, wife and daughters of appellant against disbursal of retirement benefits to him. There is no dispute that on his intestate death they would be entitled thereto.

2. Learned counsel on either side informed that the appellant is no more.

3. Recording the above submission, the Civil Miscellaneous Appeal is dismissed as abated. No costs.
