ORDER
(Through video conference) The petitioner, who was arrested and remanded to judicial custody on 09.04.2021 for the offence punishable under Sections 341, 364A, 385 & 506(i) IPC, in Crime No.962 of 2019 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the the petitioner along with other accused had kidnapped the defacto complainant's son in two wheeler and demanded Rs.10,000/- from him for the release of his son from their custody. Hence the case.
3.The learned counsel for the petitioner submit that the petitioner is an innocent person and he is no way connected with the alleged offence and he has been falsely implicated in this case and that the petitioner has been in jail from 09.04.2021. Therefore, he prays to grant bail to the petitioner.
4.The learned Government Advocate (Crl. Side) appearing for the respondent would vehemently oppose to grant bail to the petitioner stating that the petitioner and the other accused had kidnapped the defacto complainant's son and demanded Rs.10,000/- from him for the https://hcservices.ecourts.gov.in/hcservices/
release of his son from their custody. He would submit that there are totally 6 accused in this case and the petitioner is A1 and would submit that 4 previous cases has been pending against him. 5.Taking into consideration, the submission made by the learned Government Advocate (Crl.Side) and considering the nature of offence and also considering the fact that there are 4 previous cases pending against the petitioner, this Court feels that it is not a fit case to grant bail to the petitioner.
