C.M.P.No.10437 of 2019 in C.M.A.No.SR.37751 of 2018 V.M.VELUMANI, J.

This petition is filed to condone the delay of 138 days in filing the above Civil Miscellaneous Appeal.

2.The learned counsel appearing for the petitioners submitted that the first respondent is driver of the vehicle and no award was passed against the first respondent.

3.Mrs.R.Sree Vidhya, learned counsel takes notice for the second respondent/Insurance Company and submitted that the second respondent has no objection in ordering this petition.

4.Heard the learned counsel appearing for the petitioners as well as the second respondent.

5.Recording the no objection given by the learned counsel for the second respondent and being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 138 days is condoned and the petition is ordered.

6.The learned counsel for the petitioners is directed to serve the typed set of papers to Mrs.R.Sree Vidhya, learned counsel for the 2nd respondent today itself.
