Respondents PRAYER: Petition under Article 226 of the Constitution of India for issuance of a writ of mandamus directing the first respondent to consider the representations of the petitioner's Sangam dated 06.02.2019 and 15.03.2019 regarding forming a Park on the land of an extent of 12 Cents in S.No.440/5 in 40/5B in Tirumullaivoyal Village (Padmavathy Srinivasa Nagar) in Zone No.7, Ward No.79 of Chennai Corporation within a stipulated time.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard Mr.J.Muthukumaran, learned counsel for the petitioner; Mr.V.Jayaprakash Narayanan, learned Government Pleader (i/c.) for respondents 1, 3 and 4 and Mr.V.C.Selvasekaran, learned counsel for the second respondent.

2. The prayer of the petitioner is that their representations dated 6.2.2019 and 15.3.2019 in relation to 12 cents in S.No.440/5 in Padmavathy Srinivasa Nagar, Thirumullaivoyal Village, be considered by the first respondent.

3. The learned Government Pleader (i/c.) submitted that both the representations do not give necessary particulars. Both the representations do not clearly state that the said piece of land is government land, hence it would not be possible to consider the said representations.

4. Thereupon, the learned counsel for the petitioner submitted that they will prefer fresh representation to the fourth respondent, i.e., the Tahsildar, Taluk Office, Avadi, Chennai, giving all necessary material particulars within two weeks from today. If such representation is received by the fourth respondent, the fourth respondent to consider the same within a period of ten weeks from the date of receipt of the representation.

With the above observation, the writ petition is disposed of. No costs. Consequently, W.M.P.No.14048 of 2019 is closed.
