Respondent Prayer: The Criminal Original Petition is filed under Section 482 of Cr.P.C. to direct the learned Judicial Magistrate, Sriperumbudur, to expedite and dispose of the discharge petition filed by the petitioner in Crl.M.P.No.3257 of 2022 in C.C.No.199 of 2019 and conclude the same as expeditiously as possible within a stipulated time that may be fixed by this Court. ORDER
The learned counsel appearing for the petitioner submitted that the petitioner has filed a discharge petition before the learned Judicial Magistrate, Sriperumbudur, in Crl.M.P.No.3257 of 2022 in C.C.No.199 of 2019 and the same is pending for more than two years and therefore, a direction is required to expedite the disposal of the discharge petition.
2. The learned Government Advocate (Crl.Side) submitted that the respondent police has filed counter in the discharge petition and also in the petition filed for receiving additional documents and the matter was posted to 02.07.2024.
3. The learned counsel for the petitioner also submitted that since the police has come forward to participate in the discharge petition, a time may be fixed for disposal of the Miscellaneous Petition. -2-
4. Considering the above facts, the learned Judicial Magistrate, Sriperumbudur, is directed to dispose of the discharge petition in Crl.M.P.No.3257 of 2022 in C.C.No.199 of 2019 within a period of two months from today (28.06.2024).
With the above direction, this Criminal Original Petition is disposed of.
