C.M.P.No.14178 of 2022 in C.M.A.SR.No.48341 of 2022 P.T.ASHA, J., This petition is filed to condone the delay of 1713 days in filing the above appeal in C.M.A.SR.No.48341 of 2022.

2. Mr.K.Poomalai, learned counsel takes notice on behalf of the respondent-2. Private notice sent on the first respondent has been served as early as on 13.10.2022, but they have not entered appearance.

3. Heard the learned counsel for the petitioners and learned counsel for respondent2.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 1713 days in filing the above appeal in C.M.A.SR.No.48341 of 2022 is condoned.

4. The Registry is directed to number the appeal, if it is otherwise in order and list the same for admission. The Registry is also directed to print the name of Mr.K.Poomalai, learned counsel for the insurance company, when the matter is listed for admission.

5. The appellants/claimants will not be entitled to claim interest for the period of 1713 days.
