COMP. A. No.101 OF 2019 IN C.P.No.372 of 2015 SENTHILKUMAR RAMAMOORTHY, J This Company Application is filed to grant leave to the applicant to withdraw the company petition No.372 of 2015.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.

3. Both the learned counsel represented that the respondent has made payment in full and final settlement of the debts in respect of which C.P.No.372 of 2015 was filed. It is also seen that the winding up petition has not been admitted as on date and only notice was ordered. In effect, the proceedings, as on date, are in personam as between the Petitioning Creditor and the Respondent Company.

4. Accordingly, in view of the payment of a sum of Rs.7,50,000/- [Rupees Seven Lakhs Fifty Thousand only] by the respondent Company to the Petitioning Creditor in full and final settlement of the debt, this application is ordered and, consequently, C.P.No.372 of 2015, is closed as settled out of Court.
