J U D G M E N T

(Judgement of the Court was delivered by The Hon'ble Chief Justice) In view of what we have observed in order dated 07.03.2016, learned counsel for the respondents has obtained instructions and the respondent present in Court states that the suit pending before the District Court, Tuticorin, has not attained finality and it is still pending.

2. It is, thus, agreed that in so far as the impugned order is concerned, considering that the property is jointly owned and not inherited property of the family, the same be set aside and suit be restored to its original number.

The Original Side Appeal accordingly stands allowed, leaving the parties to bear their own costs.
