ORDER

This criminal original petition has been filed to quash the final report in C.C. No.839 of 2024 on the file of the learned XIII Metropolitan Magistrate, Egmore, Chennai under the ground of Compromise in respect of the petitioner/Accused-2.

2. The case of the prosecution is that on 14.02.2023, the second respondent lodged a complaint stating that he was running a grocery store at Bharathi Nagar, 2nd Street. He used to close the shop regularly at about 10:30 p.m. On 13.02.2023, at around 10:00 p.m., A1 (Boopalan) and A2 (Sathish) came to his shop, abused him using foul language, and damaged a snacks bottle using a knife. It is further alleged that A1 threatened him and extorted a sum of Rs.500/- from him, and also issued life threats. Based on the said complaint, the respondent police registered a case in Crime No.44 of 2023 for offences under Sections 294(b), 384, 427, and 506(ii) of the IPC. The respondent police was filed a final report before the learned XIII Metropolitan Magistrate, Egmore in C.C. No.839 of 2024. Page No.2 of 4

3. The case is still at the stage of investigation. By passage of time, the parties have decided to bury their hatchet and compromise the dispute amicably among themselves.

4.The petitioner/2nd accused and the 2nd respondent have filed separate affidavit before this Court and also filed the Joint Compromise Memo. The petitioner and the 2nd respondent are present. This Court also enquired both the parties and was satisfied that the parties have come to an amicable settlement between themselves.

5.Under such circumstances, no useful purpose will be served in keeping the First Information Report pending, even though, the offences involved are not compoundable in nature. In the light of the guidelines given by the Hon'ble Supreme Court reported in 2017 9 SCC 641- (Parbathbhai Aahir @ Parbathbhai Vs. State of Gujrath), and after exercising due caution as advised by the Hon'ble Suprme Court in The State of Madhya Pradesh v. Dhruv Gurjar and Another reported in (2019) 2 MLJ Crl 10), this Court in exercise of its jurisdiction under Section 482 Cr.P.C., quashes the C.C. No.839 of 2024, on the file of the XIII Metropolitan Magistrate, Egmore.
