Respondents Prayer: Writ Petition filed under Article 226 of Constitution of India, seeking for an issuance of writ of mandamus, to direct the respondents to regularise the medical leave availed by the petitioner and credit the petitioner's salary due for the above mentioned period (Para 4 of the Affidavit) with increment, bonus, surrender leave, uniform allowance from the year 2015 to 2024 and service and monetary benefits for completing 20 years in Selection Grade on 31.12.2013 and Super Selection Grade in 25 years of service on 31.12.2018 and other monetary benefits and consequential service benefits to the petitioner with reasonable interest within a time frame stipulated by this Court.

ORDER

The present writ petition has been filed to direct the respondents to regularise the medical leave availed by the petitioner and credit the petitioner's salary due for the period from 06.07.2019 to 28.07.2019 with increment, bonus, surrender leave, uniform allowance from the year 2015 to 2024 and service and monetary benefits for completing 20 years in Selection

Grade on 31.12.2013 and Super Selection Grade in 25 years of service on 31.12.2018 and other monetary benefits and consequential service benefits to the petitioner with reasonable interest.

Heard Mr.C.Rajkumar, learned Counsel for the petitioner and Mr.E.Sundaram, learned Government Advocate who takes notice for the respondent.

It is the submission of the petitioner that she was appointed as Village Health Nurse on 31.12.1993. While she was in service, she was suspended during 2015 and subsequently reinstated in the non-sensitive post. Unfortunately, her husband was also died in the year 2016 and she also met with an accident. It is the grievance of the petitioner that in spite of imposing punishment of withholding of increment for a period of 6 months and censure order in the year 2022 and 2024 respectively, the respondents have not regularised the medical leave and not paid salary and other benefits till date. Hence it necessitated the petitioner to send a representation on 24.01.2025. In spite of receipt of the abovesaid representation, the respondents did not pass any order.

However, learned Government Advocate appearing on behalf of

the respondents strenuously opposed the said contention of the petitioner. Since the petitioner has come up with the limited prayer, this Court without going into the merits of the matter deem to direct the respondents to consider the petitioner's above representation within a specified period.

In the result, the Writ Petition is disposed of with a direction to the respondents to consider the petitioner's representation dated 24.01.2025 according to its own merits and pass orders within a period of six weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
