ORDER

The petitioner who was arrested on 27.04.2021 and remanded to judicial custody for the offences under Sections 324 and 302 of the Indian Penal Code in Cr.No.120 of 2021 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that A1 is the Head Cook at the restaurant run by A2 and the deceased has joined as a Tea Master in the said restaurant only 2 days prior to the occurrence. On the date of occurrence, A1 started hitting the victim since he was demanding for higher amount of salary from A2. The specific overt act against this petitioner is that only on the instigation of A2/petitioner, A1 murdered the victim.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate (Crl. Side) vehemently opposed for grant of bail to the petitioner stating that the investigation is still in the initial stages and that the petitioner was arrested only on 27.04.2021.
