This application has been filed by the plaintiff seeking direction to Commissioner of Customs, to produce certain documents listed in the judges summons.

2. The applicant herein filed a suit seeking recovery of demurrage charges illegally withheld by the defendant. However, the applicant could not mark some of the certified copies issued by the Customs Department. In these circumstances, the applicant was constrained to file the present application seeking directions to Commissioner of Customs Chennai - 600 001, to produce the documents mentioned in the Judges Summons. In the affidavit filed in support of this petition, it is also asserted by the applicant that he had filed an application seeking legible/certified copies of the documents from the Customs Department but the same has not been furnished. 1/2 https://www.mhc.tn.gov.in/judis

3. The learned counsel for the respondent/defendant submitted that it is for the applicant to furnish the legible/certified copies of documents for the purpose of marking.

4. In view of the assertion made by the applicant that he had already filed an application seeking legible / certified copies from the Customs Department and the same has not been furnished, this Court is inclined to allow this application.
