Respondents PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the 2nd respondent to issue an "No Objection Certificate" to the petitioner to run the spa in accordance with the Official Gazette Notification 252 dated 16.07.2018 and also forbear the 2nd respondent not to unduly interfere with the peaceful conduct of the business i.e the Cross Massage of "The Magical Spa" at No.22, 22A, NSR Road, Saibaba Colony, Coimbatore-641 011.

ORDER

This petition has been filed for seeking direction to direct the 2nd respondent to issue no objection certificate to the petitioner to run the Spa on the complaint dated 16.07.2018.

2.The learned counsel appearing for the petitioner would submit that already the petitioner obtained licence to run a spa as per the Government notification dated 16.07.2018. Irrespective of the same, the 2nd respondent did not issue any no objection certificate to the petitioner to enable him to https://hcservices.ecourts.gov.in/hcservices/

run Spa.

3.Mr.S.Karthikeyan, learned Additional Public Prosecutor would submit that it is under consideration and the 2nd respondent would pass orders.

4.Considering the above facts and circumstances, the 2nd respondent is directed to consider the request of the petitioner and pass orders in accordance with law keeping in view of the fact that already licence was granted to the petitioner, within the period of two weeks from the date of receipt of copy of this order.

5.Accordingly, this Criminal Original Petition is disposed of.
