ORDER

The petition has been filed to direct the respondents to grant notional promotion to the petitioner to the post of Assistant Executive Engineer /Electrical with effect from 01.11.2014 on par with his junior Thiru. C. Chelladurai (SL. No.93) and Consequently refix the Petitioners Seniority by placing him below Thiru. Krishnamoorthy (SL. No.92) and above Thiru. C. Chelladurai (SI. No.93) and in the panel list dated 17.10.2014 and allotment order dated 01.11.2014 issued by the 2nd Respondent together with all consequential monetary and attendant benefits by considering the representations of the petitioner dated 05.01.2026 and 23.02.2026.

2. It is the case of the petitioner that the petitioner was initially appointed as Technical Assistant and subsequently, promoted as Assistant Engineer on 28.11.2003. While so, a complaint was lodged against him for an alleged demand of illegal gratification for providing new electricity service connection. Based on complaint, a trap was arranged and a FIR was registered against the

petitioner. The petitioner was suspended for six years and subsequently, the petitioner filed a writ petition in W.P.No.13365 of 2018, pursuant to which, his suspension order was revoked by proceedings dated 28.02.2019. In the meantime, due to pendency of criminal case, his name was not included in the panel for promotion. Later, the petitioner was acquitted from the said criminal case and the third respondent reinstated the petitioner into service by proceedings dated 23.10.2025.

3. Thereafter, the petitioner made a representations seeking regularization of his suspension period and dismissal period. After obtaining clearance, the third respondent regularized the petitioner's service for the said period. Thereafter, the petitioner made representations dated 05.01.2026 and 23.02.2026 seeking grant of notional promotion with refixation of seniority above his juniors, for which, there is no response till date. Therefore, the petitioner is before this Court.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the second respondent to consider the petitioner's representations dated 05.01.2026

and 23.02.2026, on merits and in accordance with law and to pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.
