ORDER
(Through video conference) The petitioner, who was arrested and remanded to judicial custody on 10.04.2021 for the offence punishable under Sections 454 and 380 IPC, in Crime No.212 of 2021 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that on 30.03.2021, the petitioner had stolen 10 sovereigns of jewels and cash totally worth about Rs.1,50,000/- from the defacto complainant's house. Hence the case.
3.The learned counsel for the petitioner submit that the petitioner is an innocent and she is no way connected with the alleged offence and she has been falsely implicated in this case and the petitioner has been in jail from 10.04.2021. Therefore, he prays to grant bail to the petitioner.
4.The learned Government Advocate (Crl. Side) appearing for the respondent would vehemently oppose to grant bail to the petitioner stating that the petitioner is a habitual offender having 13 previous cases pending against her and would submit that all cases are similar https://hcservices.ecourts.gov.in/hcservices/
in nature. He would further submit that in this case investigation has been completed and charge sheet has been filed in C.C.No.23 of 2021 before the learned Judicial Magistrate, Kangeyam. 5.Taking into consideration, the submission made by the learned Government Advocate (Crl.Side) and that the petitioner having 13 previous cases in her credit and also charge sheet has also been laid down in this case, this Court feels that it is not a fit case to grant bail to the petitioner. The learned Judicial Magistrate, Kangeyam is directed to proceed with the trial in the manner known to law during the incarceration of the petitioner. 6.This Criminal Original Petition stands dismissed accordingly. -sd/- 26/05/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
