Prayer:- Writ Petition has been filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the respondents to issue allotment order of house site and patta in favour of the petitioners pursuant to the beneficiaries list dated 15.05.1998 on the file of the 3rd respondent and the communication of the 2nd respondent dated 14.05.2007 to the 3rd respondent and based on the petitioners representation dated 24.06.2015 forthwith. By consent, the writ petition is take up for final disposal.
2. The petitioners claim that they all belong to Arunthathiyar and Adhi Dravidar Community. The Government had acquired land comprised in Survey Nos.440/1B1A, 440/1B1B and 440/1B1C situated at A.Reddihalli Village, Dharmapuri Taluk and District for the purpose of allotment of house sites. The petitioners would further state that a list of 162 beneficiaries were also identified and vide proceedings dated 15.05.1998, a decision has been taken to provide house site to an extent of 3 cents to each of the beneficiaries. The petitioners would further submit that the National Highways Authorities has taken a decision to acquire the land and subsequently allotment could not be made to 72 beneficiaries. The grievances expressed by the petitioners is that though some persons were identified and some of them were issued with patta, nothing moved thereafter. In this regard, they submitted a representation dated 24.06.2015, to all the respondents and since no order has been passed, they have forward to file this writ petition.
3. Heard the submissions of Mr.C.Prabakaran, learned counsel appearing for the petitioners and Mr.R.Govindasamy, learned Additional Government Pleader accepts notice for the respondents 1 to 3.
4. This Court without going into the merits of the case as projected by the petitioners in this writ petition or in their representation, directs the respondents 1 to 3 to consider and dispose of the representation of the petitioners dated 24.06.2015, in
accordance with law and pass orders within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioners. The writ petition is disposed of accordingly. No costs.
