PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing 1st and 2nd respondents to dispose of the representation dated 12.4.2016 and consequential relief by way of direction directing the 2nd respondent not to entertain any approval for the land comprised in S.No.130 measuring an extent of 3 1/2 acres in the name and style of Value Garden of Mambakkam Village and the same may be rejected for the above said reasons.

ORDER

Heard both and perused the records.

2. This writ petition has been filed seeking a direction to respondents 1 and 2 to dispose of the petitioner's representation dated 12.4.2016 and also for a consequential direction to the second respondent not to entertain any request for approval for the land in S.F.No.130.

3. The learned Special Government Pleader appearing for the first respondent submits that the petitioner has not produced any proof for submitting the representation and that if a fresh representation is given, that will be considered in accordance with law.

4. In the light of the said submission made by the learned Special Government Pleader and the limited scope of the prayer sought for in this writ petition, without expressing any opinion on the merits, the writ petition is disposed with a direction to the petitioner to give a fresh representation, along with a copy of this order, to the first respondent within two weeks from the date of receipt of a copy of this order. On receipt of such a representation, the first respondent shall consider the same on merits and pass appropriate orders in accordance with law, within a period of twelve weeks therefrom. No costs. Consequently, the connected WMP is closed.
