(Order of the Court was made by the Hon'ble Chief Justice) Heard on the application for condonation of the delay of 914 days in representation of the writ appeal.

2.The delay in representation is said to have been caused due to the pandemic COVID-19. The facts available on record shows that the appeal preferred by the applicant was returned on 17.10.2019, but no representation was made immediately to cure the defects; rather it was done after a lapse of 914 days. The COVID-19 affected the working lately in the month of March 2020 and in the intervening period of more than four months and even thereafter also representation could have been done. Therefore, the sufferance of the earlier counsel with COVID and the time taken to file change of vakalat cannot be justified.

3. We do not find any justification to condone the delay of 914 days in representation. Accordingly, the petition is dismissed. (M.N.B., CJ) (N.M.,J.) 24.06.2022 kst
