Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus to direct the respondents to save and protect the pond and its all canals by removing all type of obstructions, barrier and blockage for gathering rain waters into the pond ''Patchiat Gounder Kuttai'' situated in Survey no.59 of H.Puthupatti, Pappirettypatty Village Union, Dharmapuri District and maintain it in accordance with law.

(Order of the Court was made by The Hon'ble Chief Justice) The petitioner is aggrieved by the inaction on part of the respondent authorities in maintaining the pond by the name of ''Patchai Gounder Kuttai'' used by H.Puthupatti villagers for gathering rain water for agricultural purposes. A representation was made on 24.02.2014 by the petitioner and on the same, a communication was issued on 21.10.2014 by the Block Development Officer / the https://hcservices.ecourts.gov.in/hcservices/

second respondent to the Tahsildar / the third respondent, for removal of encroachment in the pond. It is, however, stated that no action has been taken, though the third respondent has inspected the pond even prior to that communication.

2.In the conspectus of the aforesaid, the second and third respondents are directed to carry out the necessary exercise in accordance with law, after notice to all concerned, within a period of one month of receipt of this order.
