ORDER : The Court Made the following order :- (1)The petitioner, who was arrested and remanded to judicial custody on 01.03.2022 for the alleged offences punishable under Sections 147, 148, 341, 294[b], 392, 397 and 506(II) of IPC in Crime No.221 of 2022 on the file of the respondent police, seeks bail. (2)The case of the prosecution is that the petitioner along with the other accused threatened and robbed a sum of Rs.600/- at knife point from the defacto complainant, resulting in the registration of the case.

(3)The learned counsel for the petitioner would submit that the petitioner is innocent and he is no way connected with the crime and his name is not find place in the FIR. The learned counsel submitted that the petitioner is undergoing incarceration for a period of 72 days and hence, prays for enlargement of the petitioner on bail.

(4)The learned Government Advocate(Crl.Side) appearing for the respondent would submit that totally there are six accused and the petitioner is arrayed as A5. It is further submitted that the investigation is at the crucial stage and the petitioner has got 1 previous case under Section 302 IPC and hence, strongly opposed for the grant of bail to the petitioner. He would also submit that A1 was already booked under the Act 14/1982.

(5)Considering the facts and circumstances of the case and the gravity of the offence and further that steps are being taken by the respondent police to detain A1 under the Goondas Act and also taking into consideration of the fact that the petitioner has got 1 previous case of murder, this Court is not inclined to grant the relief of bail to the petitioner.
