2. The learned counsel for the petitioner would submit that there is absolutely no clear and categorical evidence as to the commission of the offence by the petitioner and therefore, pray for suspension of sentence.

3. On a perusal of the case records, it is the allegation that the petitioner forcibly indulged in sexual assault with the victim child. Therefore, I am of the view that sentence imposed on the petitioner cannot be suspended.
