ORDER

The petitioner, who was arrested and remanded to judicial custody on 30.10.2025 for the alleged offence under Section 65(2) of BNS Act read with Sections 5(l), 5(n), 5(m), 9(m), 6(1) of POCSO Act, 2012, in Crime No.58 of 2025 on the file of the respondent police, seeks bail. 1/4

2. The case of the prosecution is that the petitioner has allegedly committed aggravated penetrative sexual assault against the victim girl aged about 11 years. Hence, the above case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in the present case and that he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been in judicial custody since 30.10.2025 and he is ready to co-operate with the investigation and abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent Police strongly opposed the bail petition on the ground that though there are 3 accused, the petitioner is the 3rd accused in this case and they were committed gang sexual assault on the victim girl. Hence, he opposed the grant of bail to the petitioner.

5. Considering the severity of the allegation and the gang sexual assault suffered by the victim at the hands of the petitioner, this Court is of the view that, if the petitioner is enlarged on bail, it would jeopardize the prosecution 2/4

and cause mental trauma to the victim girl. Hence, this Court is not inclined to grant bail to the petitioner.
