ILANTHIRAIYAN Susila Yuvaraj ..Petitioner Vs S.Mohan ..Respondent Prayer : Criminal Revision Case is filed under Section 397 and 401 of the Code of Criminal Procedure to call for the records and set aside the judgment of the learned VII Additional Sessions Judge, Chennai, made in Criminal Appeal No.58 of 2019 dated 15.03.2021 confirming the conviction and sentence passed by the learned Metropolitan Magistrate FTC IV, George Town, Chennai made in C.C.No.1548 of 2016 by Judgment dated 22.02.2019 convicting the petitioner under Section 138 of Negotiable Instruments Act and Sentencing her to undergo ten months simple imprisonment and to pay a compensation of Rs.4,00,000/- under Section 357(3) of Cr.P.C within one month and in default of payment of the compensation to undergo further period of two months simple imprisonment.

ORDER
This Criminal Revision Case has been filed as against the Judgment dated 15.03.2021 passed in C.A.No.58 of 2019 on the file of the VII Additional
Sessions Judge, Chennai, thereby confirming the conviction and sentence imposed by the Metropolitan Magistrate, FTC_IV, George Town, Chennai, in C.C.No.1548 of 2016 dated 22.02.2019, for the offence punishable under Section 138 of the Negotiable Instruments Act. 2.
Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioner is the accused in the complaint lodged by the respondent for the offence punishable under Section 138 of the Negotiable Instruments Act. After a full-fledged trial, the Trial Court found the accused guilty and convicted him for the said offence and the same was confirmed by the Appellate Court. Hence, the present Criminal Revision Case has been filed. 4.
Pending revision, it is submitted that the parties have amicably settled the dispute and the petitioner has paid the entire cheque amount to the respondent and also entered into a compromise. 5.
In view of the above settlement, the Judgment dated 15.03.2021 passed in C.A.No.58 of 2019 on the file of the VII Additional Sessions Judge, Chennai, confirming the conviction and sentence imposed by the Metropolitan Magistrate, FTC_IV, George Town, Chennai, in C.C.No.1548 of 2016 dated
22.02.2019, is hereby set aside and the terms of Joint Memo of Compromise, dated 20.09.2019 shall form part and parcel of this order. 6.
